How many days of annual leave?
Under Article 53(4) of Turkish Labour Law No. 4857, paid annual leave cannot be less than the following, depending on length of service:
| Length of service | Minimum leave |
|---|---|
| 1 to 5 years (5 years included) | 14 days |
| More than 5 and less than 15 years | 20 days |
| 15 years (included) or more | 26 days |
- The right arises after at least one year of work at the workplace, including the probation period (Art. 53(1)); later entitlements are counted each year from the day the previous one arose (Art. 54(3)).
- Employees aged 18 or under and 50 or over cannot get less than 20 days (Art. 53(5)).
- For underground work, annual leave is increased by four days (Art. 53(4), added by Law No. 6552).
- These are minimums; employment and collective agreements can increase them but not reduce them (Art. 53(6)).
- Weekly rest days, national holidays and public holidays falling within the leave are not counted as leave days (Art. 56(5)).
- The right to annual leave cannot be waived (Art. 53(2)); unused leave does not expire and is paid at the final wage when the contract ends (Art. 59).
Frequently asked questions
How many days of annual leave do employees get?
At least 14 days for 1 to 5 years of service (5 years included), at least 20 days for more than 5 and less than 15 years, and at least 26 days for 15 years or more (Labour Law Art. 53(4)). Employees aged 18 or under and 50 or over get at least 20 days.
When is annual leave earned?
The first entitlement arises after at least one year of work at the workplace, including probation (Art. 53(1)). Later entitlements are counted each year from the day the previous one arose (Art. 54(3)).
How much annual leave do employees aged 50 or over get?
An employee who is 50 or over on the accrual date gets at least 20 days; with 15 or more years of service, 26 days apply (Art. 53(5)).
Are public holidays and weekends deducted from annual leave?
No. Weekly rest days, national holidays and public holidays falling within the leave are not counted as leave days (Art. 56(5)). Whether Saturday counts depends on the workplace's working pattern.
Does unused annual leave expire?
No. The right cannot be waived (Art. 53(2)); unused leave accumulates and is paid at the wage on the termination date when the contract ends for any reason (Art. 59).
Does unpaid leave affect annual leave entitlement?
Unpaid leave is not among the periods counted as worked under Art. 55, so it pushes the next accrual date forward by the number of unpaid days (Art. 54(2)). Enter it under “periods that do not count” to see the effect.
This tool calculates the minimum periods under Turkish Labour Law No. 4857 and is for information only; it is not legal advice. Your employment or collective agreement may provide more leave; seasonal and campaign work (Art. 53(3)) and employment under other laws are out of scope.
