How is overtime calculated?
Art. 41 of the Labour Law distinguishes two kinds of extra work and applies a different premium or time off to each.
| Type | Pay | Time off in lieu (per hour) |
|---|---|---|
| Overtime (beyond 45 hours) | 50% premium | 1 hour 30 minutes |
| Extended hours (between contract hours and 45 hours) | 25% premium | 1 hour 15 minutes |
- Overtime requires the employee's written consent; at most 270 hours of overtime a year are allowed (Art. 41/7–8).
- The employee may choose time off instead of pay; time off in lieu must be used within six months (Art. 41/4–5).
- The hourly wage is the monthly wage divided by 225 hours (30 days × 7.5 hours), in line with Court of Cassation practice.
- Daily working time cannot exceed 11 hours; where 45 hours are distributed unevenly across the week, the weekly average applies (Art. 63).
Frequently asked questions
What is the overtime premium?
For overtime beyond 45 hours a week, the hourly wage is paid with a 50% premium. If the contract sets fewer than 45 hours, extended hours between the contract hours and 45 hours are paid with a 25% premium (Labour Law, Art. 41).
Can time off be taken instead of overtime pay?
Yes. If the employee wishes, they take 1 hour 30 minutes off for each hour of overtime and 1 hour 15 minutes for each hour of extended hours; this time must be used within six months (Art. 41/4–5).
How many hours of overtime are allowed per year?
270 hours a year (Art. 41/8). The employee's written consent must be obtained for overtime.
How is the hourly wage calculated?
The monthly gross wage is divided by 225 (30 days × 7.5 hours). For example, an employee earning 45,000 TL gross a month has an hourly wage of 200 TL and an overtime hourly rate of 300 TL.
