How is leave pay calculated?
However the employment contract ends, the employee or their heirs are paid for unused annual leave days (Labour Law, Art. 59).
- The daily wage is the monthly gross wage divided by 30; leave pay is the daily wage multiplied by the number of unused days.
- The calculation uses the basic wage on the date the contract ends; overtime pay, bonuses and social benefits are not added (Regulation, Art. 21; Court of Cassation, 9th Civil Chamber, E.2016/1579, K.2019/7058).
- Unused annual leave does not expire: all days carried over from earlier years are included.
- The limitation period for leave pay is five years from the date the contract ends (Additional Art. 3).
- Leave cannot be converted into pay while employment continues; it turns into pay only when the contract ends.
Frequently asked questions
How is unused leave pay calculated?
The monthly gross basic wage is divided by 30 to get the daily wage, which is multiplied by the number of unused annual leave days. For example, an employee earning 45,000 TL gross a month with 20 unused days is owed 30,000 TL gross.
Is leave pay owed to an employee who resigns?
Yes. The law provides that unused leave is paid when the employment contract ends for any reason (Labour Law, Art. 59), including resignation.
Are bonuses included in leave pay?
No. Overtime pay, bonuses and social benefits are not included; the calculation uses the basic wage (Annual Paid Leave Regulation, Art. 21).
Are tax and social security deducted from leave pay?
Yes. Unused leave pay is a wage payment; payroll deducts the social security premium, unemployment insurance premium, income tax and stamp duty. This tool calculates the gross amount.
How many years back can leave pay be claimed?
The limitation period is five years from the end of the contract (Additional Art. 3). Within that period, pay for leave unused over the whole period of service can be claimed.
